HOWELL AND CHRISTMAS IS ACTIVE IN OUR COMMUNITY
 
Howell and Christmas has always made protecting our children one of our highest priorities. In addition to our traditional role of securing responsibility for our young clients who are victims of accidents and abuse, we are now expanding our efforts to protect our children, even those who are not our clients. Recently we launched our “Helmets for Kids” program. The program aims to supply, free of charge, bicycle, skateboard, and scooter helmets to deserving children in our community. A large quantity of our first shipment of new helmets have now arrived, and attorney Howell is in talks with local law enforcement to supply police cars with new helmets that officers may hand out to young cycling children that police encounter in their patrols. The aim is to focus the distribution in the more economically depressed neighborhoods where the children’s parents may not be able to afford new helmets.
 
Howell and Christmas not only care about ALL children in our community – we are taking action to protect them.

Insurance Compaines Owe a Duty of Good Faith

Attorney Howell represents a client that was hit by a reckless driver.  Our client was riding on a motorcycle, and after the wreck, the driver of the automobile yelled obscenities to our client before fleeing the scene.  Our client was severely injured, was in need of surgery to treat his injuries, and in all likelihood will not be able to return to his job as a result of this wreck.
 
Attorney Howell documented the damages and submitted our client's claim to the insurance company for the car driver.  Despite  the fact that the insurance company carried only $25,000.00 in policy limits, the insurance company continued to refuse to tender its policy limits despite repeated demands and deadlines set by Attorney Howell.  After expiration of the final deadline, Attorney Howell filed a lawsuit for the client.  Immediately upon learning of the lawsuit, the insurance company  tried to tender its policy limits of $25,000.00.  Attorney Howell refused to accept this amount now.  Because  the insurance company breached its duty of good faith to the car driver by failing to settle the case when it should have, the insurance company will likely ultimately pay our client much more than its policy limits.
 
The laws establishing the duties owed by insurance companies are complex.  You should be wary of any dealings you may have with an insurance company without consulting a competent lawyer.  Call Howell and Christmas any time you have any question about an insurance claim.


Big Businesses are Stealing from You.

Howell and Christmas, LLC would like to inform you about a documentary that is on the air this summer on HBO.  It is called “Hot Coffee”.  We feel it is important for everyone to watch this documentary so you may learn how big businesses are stealing your rights away from you.  The documentary uses the now-infamous legal battle over a spilled cup of McDonald’s coffee as a springboard.  The documentary follows four people, including McDonald’s plaintiff Stella Liebeck, whose lives have been affected by their inability to access the courts, and examines the role of corporations and a complicit media in promoting “tort-reform”.  The documentary “Hot Coffee” examines the dangers of so-called “tort-reform” and its threat to our civil justice system.  The documentary is directed by a former trial lawyer and first-time filmmaker Susan Saladoff.  This film is one of the selections of the 2011 Sundance Film Festival.
