You be the judge.

You're wearing the robe and holding the gavel for this courtroom evidence game.  Make the right call and justice is fairly dispensed.  Make the wrong call and you'll be embarrassed when the Supreme Court reverses your ruling.

Facts: Frankie Felon, accused of killing a store clerk during a robbery in downtown Charleston, is on trial for murder.  The prosecutor elicits a testimony from Nellie Neighbor that moments after the shooting she saw her friend, Bessy Busybody, frantically running down the street screaming, "I saw Frankie shoot him! I saw Frankie shoot him!"

Objection: The defense lawyer says, "Objection, your honor.  That's hearsay.  If the prosecutor wants to get that testimony in, he will have to call Bessy Busybody as a witness.  The defendant moves this court to instruct the jury to disregard that part of Nellie Neighbor's testimony."

"Sustained" or "overruled," Judge?  The parties are waiting on your ruling.  Visit our twitter page to reveal the answer.

Eye on the Ball

Howell and Christmas wins $11+ million settlement

Attorney Lad Howell recently closed a file in which he represented a passenger in a horrible tractor trailer accident.  A different lawyer represented another passenger traveling in the same car as Lad’s client.  Both clients suffered terrible injuries.

In the beginning of the case, it appeared to everyone investigating the case that the driver of the car, not the driver of the 18 wheeler, was the sole cause of the crash.  The insurance company for the car driver offered Lad’s client and the other lawyer’s client the insurance policy limits to sign a release.  The total of the limits was less than $50,000.00.

The other lawyer accepted the money for his client and closed his file within a few months after the wreck.  Lad did not accept the money, and instead investigated deeper into the case. The investigation revealed many missteps and negligent acts by the trucking company and its driver, including the fact that almost all brakes on the 18 wheeler failed inspection at the scene of the wreck.  Lad’s client’s case did not settle in mere months after the wreck, and it did not settle for less than $50,000.00.  Lad’s client’s case settled for more than $11,000,000.00 almost three years after the wreck.

Lad keeps his eye on the ball.  Always.
